Public Hearing Scheduled for “Rule 5” General Permit Revisions

On Wednesday, May 13 at 1:30 p.m., at the Indiana Government Center South, 10 North Senate Avenue, Conference Center Room A, Indianapolis, Indiana, the Environmental Rules Board will hold a public hearing on amendments to 327 IAC 5 and 327 IAC 15 concerning National Pollutant Discharge Elimination System general permits (NPDES). The purpose of this hearing is to receive comments from the public prior to consideration of final adoption of these rules by the board. All interested persons are invited and will be given reasonable opportunity to express their views concerning the proposed amendments. Oral statements will be heard, but, for the accuracy of the record, all comments should be submitted in writing. FMCSA Announces Exemption Renewal for Concrete Pump Operators

The Federal Motor Carrier Safety Administration (FMCSA) has renewed the American Concrete Pumping Association (ACPA) exemption (Effective Oct. 9, 2019, Expires Oct. 9, 2024) from the 30-minute rest break requirement in the Agency’s hours-of-service (HOS) regulations for commercial motor vehicle (CMV) drivers. The exemption enables all concrete pump operators, concrete pumping companies, and drivers who operate concrete pumps in interstate commerce to count on-duty time while attending equipment but performing no other work-related activity toward the 30-minute rest break provision of the HOS regulations. FMCSA has analyzed the exemption application and the public comments and has determined that the exemption, subject to the terms and conditions imposed, will achieve a level of safety that is equivalent to, or greater than, the level that would be achieved absent such exemption.

019 | Contractor Payroll Management Solution

Good morning, Ladies and Gentlemen.

I would like to introduce you to your new Contractor Payroll Management Solution, or CPMS. Say goodbye to hundreds of payroll emails, printing to PDF, and the SiteManager attachment process. No more confusion as to whether payroll has been required, received, or reviewed. As of July, new payroll will be entered by your Prime into CPMS. (Any payroll prior to July 1 will need to be entered the previous way.)

The new visual interface will use data entered into DWRs by your field personnel to determine which contractors were working and when. Your contracts and all approved contractors will show up when you log in, and which required payrolls have yet to be received. The more accurate your DWRs the better, as CPMS will hold your Prime, sub, and even trucking payrolls; so instruct your HTs to be thorough, and if they miss something, feel free to override. Additionally, it is still on the Prime contractor to upload payrolls, whether CPMS has marked it or not.

Feel free to look through the CPMS Manual and familiarize yourself with the interface, as, barring any last-minute setbacks, the system is planned to be ready for July 1, 2019.

Utility Excavator Filing Requirement Repealed in 2019 Session

Excavators contracting with utility facility operators or owners are no longer required to file a statement of compliance with the Indiana Secretary of State’s office as of May 1, 2019.

House Bill 1487 repealed Indiana Code language, which was enacted in 2018, that required utility excavators to file a statement of compliance with their annual registration due to the Indiana Secretary of State’s office. The filing required a $30 filing fee. The Secretary of State’s office is working to return filings and fees to excavator’s that submitted after May 1, 2019.  

Comment on Annual Employment Data Requirement

The Federal Highway Administration (FHWA) opened up a comment public comment period regarding the annual employment data submission requirement regulation Title 23, Part 140(a). Contractors and state transportation agencies must submit employment data annully from federal aid transportation construction contracts on form PR-1391, Federal-Aid Highway Construction Contractors Summary of Employment Data. This report provides employment workforce data including the number of minorities, women, and nonminorities in specific highway construction job categories. For additional details about the requirements, use of data, and the request for comment, please see the Federal Register Notice 2019-11768.

Review Board to Cover Portland Cement Monitoring

The Indiana Department of Environmental Management (IDEM) has proposed an amendment to Indiana Administrative Code (IAC) 326 IAC 3-5-1(b)(5) concerning the requirement for Portland cement plant kilns and clinker coolers to monitor opacity. ICI published a IDEM’s notice in the December 12, 2018 ICI newsletter. The Environmental Review Board plans to hold a hearing and vote on the preliminary draft rule during the February 13, 2019 Board meeting (meeting agenda).

The Board meeting will be held on Wednesday, February 13, 2019, 1:30 p.m. at the Indiana Government Center South in Conference Room A. The public entrance is located at 10 North Senate Avenue (access from W. Washington Street).
